RKA INFOTECH, LLC d/b/a UniverseJobs.com ("RKA") collects certain information through our website, located at www.universejobs.com (our "Website"). This page (this "Privacy Policy") lays out our policies and procedures surrounding the collection and handling of any such information that identifies an individual user or that could be used to contact or locate him or her ("Personally Identifiable Information" or "PII").

This Privacy Policy applies to two types of users. The term "Job Seeker" means a user who is job seeker, applicant, employee, candidate, etc. The term "Employer" means a user who is a representative of an employer, company, job provider, etc. Different data will be collected from the two types of users. The term "User" or "you" means either a Job Seeker or an Employer.

This Privacy Policy applies only to our Website, and to the services (our "Services") we provide through our Website. It does not apply to any third party site or service linked to our Website or recommended or referred by our Website or by our staff.

Your use of our Website constitutes an acceptance of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, immediately discontinue use of our Website. To revoke consent to the use of your PII and to have your PII removed from RKA's database, contact the RKA using the Contact Information listed at the end of this Privacy Policy and your account and profile will be deleted.

Our Website may contain links to other websites. RKA does not have any control over these other websites and, therefore, RKA is not responsible for the privacy policies or practices of these thirdparty websites. You should familiarize yourself with the privacy policies of these websites to understand how these third parties collect, share, and use your information.

RKA is also unable to control the use of your information by the employers with whom RKA shares your data. In addition, RKA is unable to control the use of your information by (i) entities or individuals who access your information when you submit your PII to a specific party or (ii) third parties with whom RKA has a relationship in order to present you with personalized ads.

A. What information does RKA collect?

The PII that RKA collects from you when you create a profile as a Job Seeker or buy our Services as an Employer includes, but is not limited to: name, e-mail address, telephone number, address, and for an Employer, credit card information (such as number, expiration date, billing address, and location data).

RKA also collects non-PII such as cookies that track the amount of time you spend on our Website.

More specifically, RKA may include collect the following types of information:

1. Your PII.
a. Your PII when you provide it or if we collect it as described in Paragraph E. (You may perform job searches and read the general content of our Website without providing this PII.)
b. Your username and password for our Website.
c. (For Employer) Your credit card information, including card number, security code, expiration date, cardholder name and billing address, when you buy our Services.
d. (For Employer) Your location and contact information, such as phone number, address, and email.
e. (For Job Seeker) Your demographic information (such as zip code, occupation, education, experience, age, gender, race, and ethnicity).
f. (For Job Seeker) Your job search behavior and preferences including a record of searches you have made on our Website.
g. Any other information that you submit to RKA.
h. Any other information that may be included in information provided to RKA by third parties.
2. Your non-PII.
a. RKA may use analytic and reporting technologies (such as cookies and web beacons) to collect anonymous information from you. Examples of this anonymous information are: your browser type, your device's operating system, date/time of access to our Website, and geographic information.
b. Although it is possible that non-PII may be used to identify you, RKA will not use it for this purpose.
B. Where does RKA store your information?

RKA stores the information it collects from our Website in servers located in the United States. Therefore, your information is governed under the laws of the United States. If you reside outside the United States, your use of our Website acts as your consent to transfer your PII outside of your country of residence into the United States.

C. How does RKA use your information?

RKA does not sell, rent, or share your PII in any ways other than those described below.

You have consented to RKA's use of your information by your registration on our Website. RKA may use your information in any of the following ways:

  1. As a Job Seeker, RKA uses your PII and your non-PII to market you to potential employers when you post your resume/profile as public on our Website. If you have specified that your resume/profile should be kept private, RKA only uses your PII and your non-PII to market you to potential employers when you apply for a specific position. If you have selected an anonymous privacy setting, your PII will not be shared with anyone unless you have failed to remove any such PII from your resume. (A description of RKA's Privacy Levels is contained in Paragraph E.)
  2. RKA reserves the right to make full use of your non-PII. RKA may use this information for the purposes of demographics and analytics. RKA may sell this demographic information to third parties or may use this demographic information to solicit advertising for our Website. In addition, RKA may use this non-PII for the purpose of analyzing traffic to our Website. This use may include those to provide better service to visitors of our Website, to customize our Website based on your preferences, to compile and analyze statistics about the traffic to our Website.
  3. RKA may use your information to register, manage, and maintain your account.
  4. RKA may use your information to process, validate, and deliver your purchases (examples: processing credit card transactions and contacting you about your orders).
  5. RKA may use Job Seeker information to maintain a record of positions you have viewed or you have applied to from our Website.
  6. RKA may use Job Seeker information to contact you about job postings that may be of interest to you.
  7. RKA may use your information to communicate with you regarding administrative notices or your use of our Website.
  8. RKA may use your information to contact you about security and feature updates.
  9. RKA may use your information to provide our Services as requested by you.
  10. RKA may use your information to analyze trends and statistics on our Website. These trends and statistics may be related to a Job Seeker's use of our Website, jobs 3 viewed by you, jobs applied for by you, and any other trends and statistics RKA views relevant to the analysis of our Website.
  11. RKA may use your information to assist RKA in our operation, evaluation, and improvement of our Website or our Services.
  12. RKA may use your information to enforcement RKA's Terms of Use.
  13. RKA may use your information if needed to manage risk if we suspect fraud, unauthorized transactions, or other security breaches on our Website.
  14. RKA may use your PII to communicate with you via e-mail, text messages, or phone calls). You may opt-out of these communications by following the instructions in Paragraph L.
  15. RKA may use your information if necessary for compliance with applicable legal requirements, industry standards, or RKA policies.

RKA shall not link your PII with your non-PII in a way that would serve to identify your behaviors on a personal level. As an example, RKA will not keep a record of how many times you have personally visited our Website. Instead, RKA may conglomerate your usage statistics with those of others to look for trends.

RKA abides by the Electronic Communications Privacy Act of 1986, 18 U.S.C. §§ 2701- 2711 ("ECPA"). All e-mail messages and other electronic communications sent through our Website and only viewable to those to whom they are sent are considered as confidential and private except as required by law, including without limitation, the ECPA. Our Website are not considered a "secured communications medium" under the ECPA. We have a limited ability to intercept and/or disclose electronic messages. Some of the situations under which we are allowed to intercept and disclose electronic messages is when we receive a court order, subpoena, warrant, or other legal demand and when we receive information that appears to be related to a criminal act.

D. How does RKA collect your information?
  1. Collection of PII

    RKA collects your information, including PII, during the registration process for both Employers and Job Seekers, including when a Job Seeker posts a resume. RKA may also collect PII when you communicate with us via e-mail, telephone, or our Website. RKA may collect information about you through social media or through your participation in events, contests, and other promotions. In addition, RKA may obtain information about you from our parent, affiliate or subsidiary companies, business partners and other third parties, as well as from publicly available information.

    In addition, our Website also contain a forum where you can share information with others. Any information you choose to share on this forum can be viewed by all other registered users.

  2. 2. Collection of non-PII

    RKA collects non-PII by the use of browser cookies, zombie cookies, web beacons, and other analytic and reporting technologies. This collection of non-PII may be done passively (i.e., without your affirmative consent) while you are using our Website.

    a. Browser Cookies

    A browser cookie is a small file usually used to persist data between browser sessions by saving certain pieces of non-PII. It allows the browser to "remember" what you did the last time you visited a particular site. They can also be used to create long-term records of your browsing history.

    Third-party browser cookies are browser cookies that are not maintained or managed by the owner of the primary website you are visiting. Advertisers usually own and maintain these third-party cookies and these advertisers use this third-party cookie information to track your browsing history across many websites, all of which have ads by the same advertiser. When your data is combined with the browsing history of other users, the third-party advertisers can detect trends and determine on which sites their advertising is returning the most value for them.

    RKA may use browser cookies and allow third parties to use browser cookies for the purposes of providing you with a better web experience by remembering information from your previous sessions and for analyzing user traffic, trends, and other useful statistical information. This cookie information may be passed to third parties if required by law or when third parties need the information to do data analysis.

    You may delete these cookies or, by using a setting in your browser, disable the use of cookies altogether but your browsing experience on our Website will not be as robust.

    RKA shall not use browser cookies to collect PII. PII will only be collected in accordance with Paragraph D.1 of this Privacy Policy.

    b. Zombie Cookies

    A zombie cookie (for example, a Flash cookie) is not the same as a browser cookie. A zombie cookie is automatically re-created after you delete it by saving a unique ID that is stored in a different place from browser cookies. Therefore, zombie cookies may be present on your computer even if you have disabled the use of cookies from your browser.

    RKA may allow its advertisers to use zombie cookies so they may target your interests, not by collecting PII but by tracking your use of our Website and other websites. These zombie cookies track your behavior on the web to improve your user experience by providing you with advertisements for services and products that are of personal interest to you. While RKA will allow you to opt-out of zombie cookies over which we have control, RKA does not have control of third-party behavioral ads and, therefore, it may be more difficult to effectively opt-out of such third-party zombie cookie use.

    These zombie cookies may also be used for the purpose of crediting third-parties who have directed you to our Website.

    If you would like to delete these zombie cookies, search the web for "how to delete a zombie cookie" or "how to delete a flash cookie."

    RKA shall not use zombie cookies to collect PII. PII will only be collected in accordance with Paragraph D.1 of this Privacy Policy.

    c. Web Beacons

    Web beacons (also know as web bugs, tracking bugs, tags, or page tags) are small snippets of computer code that are used to allow a website to transfer or to collect information. (Web beacons are invisible to the user.)

    RKA may use web beacons to understand how you and other users use our Website, to improve our products and services, to optimize your browsing experience, and to do other statistical analysis of visitors to our Website.

    RKA shall not use web beacons to collect PII. PII will only be collected in accordance with Paragraph D.1 of this Privacy Policy.

    d. Other Analytic and Reporting Technologies

    RKA may also use other analytic and reporting technologies to better understand how you and other users use our Website, to improve our products and services, to optimize your browsing experience, to provide you with advertising customized to your interests, and to do other statistical analysis of visitors to our Website. RKA shall not use any of these analytic and reporting technologies to collect PII. PII will only be collected in accordance with Paragraph D.1 of this Privacy Policy.

E. What are RKA's privacy levels?

Our Website have three levels of privacy: (i) visible, (ii) limited, and (iii) restricted. You select this level of privacy when you submit your resume/profile.

These three privacy levels are described below:

  1. Visible: Your resume as well as and all the information, including PII, in your profile. Is visible to employers, Employers may initiate contact with a Job Seeker or a Job Seeker may initiate contact with employers.
  2. Limited: A Job Seeker's resume is available to be viewed by any Employer, however any identifiable information will not be visible. Any prospective Employer may e-mail you through the Site's internal anonymous contact functionality. It will then be at the Job Seeker's discretion to respond anonymously and, then, if and when to communicate identifiable information to the specific Employer as part of Employer's recruitment process. You may also apply to job postings without your identifiable information being visible. This privacy level shields the PII you enter in your profile from view. However, RKA does NOT parse your resume to remove PII. You are responsible for removing all contact information and other PII from your resume before posting it.
  3. Restricted. Your resume and contact information is hidden to employers. Job Seeker initiates all contact with potential employers. This option allows you to share your information only when you choose to apply for a job with an Employer. Employers can view your profile/resume, including PII, but only when you apply for a position.

You may change your privacy level at any time but you are responsible for editing your resume to reflect the desired privacy level. RKA does NOT parse your resume to remove PII.

F. How does RKA protect PII?

RKA uses reasonable practices and technologies to safeguard your information against illegal intrusion and unauthorized access. No security measures are 100% reliable, however. Therefore, RKA cannot warranty the security of your PII.

RKA does not guarantee that your PII will never be compromised because no electronic transmission is completely secure. Even though RKA will employ every reasonable security measure to protect the privacy of your PII, RKA cannot guarantee that these security measures will be sufficient or that they will never fail or be circumvented.

RKA uses the SSL (Secure Socket Layer) protocol to encrypt any information that you transmit to RKA either through our registration process or during your purchase of our Services.

You have the responsibility of protecting your RKA username and password. You must contact RKA (using the contact information in Paragraph M) if you have reason to believe that your account has been compromised. In addition, you agree that you will not share your RKA username and password with anyone else. You also understand that you should always log out of our Website when you are finished with your session.

RKA will never send you any communication (e-mail or otherwise) asking for your account username or password. If you receive any such communication that looks like it is from RKA, do not respond to the communication and immediately report such communication to RKA at the contact information in Paragraph M.

You understand and agree that you are using our Website at your own risk. You assume all responsibility and risk for your use of our Website and understand that the documents and information that you post on our Website are posted at your own risk.

G. Who has access to your PII?
  1. Employers.

    If you have specified that your resume/profile should be kept private (see Privacy Levels in Paragraph E), the employer to whose specific position you have applied has access to your information (including PII). Employers to whom you have applied may contact you directly using the information contained in your resume. In the event that an employer contacts you directly, your resume (including your PII) may become a part of that employer's database. Once your resume is in an employer's database, the employer's copy of your resume is subject to the privacy policy of the employer and RKA has no control over how that employer uses or distributes your PII. RKA assumes no responsibility for an employer's use or distribution of your PII once your PII has been downloaded to the employer's database.

    If you have chosen an anonymous privacy setting, RKA will not share your PII with anyone. However, it is your responsibility to remove all PII from any resume you post if you desire to stay anonymous. (See description of RKA Privacy Levels in Paragraph E.) In addition, once you have given an employer access to your information, your information is no longer covered under RKA's Privacy Policy. Once your resume is in an employer's database, the employer's copy of your resume is subject to the privacy policy of the employer and RKA has no control over how that employer uses or distributes your PII. RKA assumes no responsibility for an employer's use or distribution of your PII once your PII has been downloaded to the employer’s database.

  2. Third Party Links

    RKA may have links to third party websites on our Website. These third parties are provided to give you access to other resources, products, and services. Once you click on a third party's link that is accessible from our Website, your PII is covered under the privacy policy of that third party and is no longer under the control of RKA.

  3. Service Providers

    RKA may disclose your PII to service providers who maintain our Website and to service providers who process our payments. These trusted service providers will have access to your PII but may not use your PII for any purposes other than those to which they have been entrusted. RKA shall use reasonable efforts to ensure that these service providers hold your PII in confidence. In addition, RKA shall only disclose your PII to third parties that RKA believes in good faith follow acceptable privacy and security policies.

  4. Legal Enforcement

    RKA may disclose your PII to investigate or enforce violations of our rights. RKA may also disclose your PII to protect the security of our Website. In addition, RKA reserves the right to disclose your PII if RKA has a good faith belief that this disclosure is necessary to satisfy a legal process or enforceable government request (such as a subpoena) or to be in compliance with any law or regulation.

  5. Affiliated Entities

    RKA may provide your PII to our affiliated entities (entities that we legally control or that control us) including our subsidiaries.

  6. Successors

    RKA may transfer your PII as part of a sale, merger, acquisition, or any other change of control. In addition, RKA reserves the right to transfer your PII to protect RKA's legal rights in the unlikely of a bankruptcy, reorganization, receivership, assignment, or any application of creditors' rights.

  7. Third-Party Marketing Affiliates

    RKA may disclose your PII to any third-party marketing affiliates who have directed you to our Website for purposes of sales by us. RKA may also disclose your PII to any third-party marketing partners who may participate in the fulfillment. Since you were directed to our Website by these third parties, any information that you provided them is also subject to the third party’s privacy policy.

    RKA may also direct you to third-party marketing affiliates. In this case, RKA may disclose your PII for the purposes of transaction processing, fulfillment, and support. You may opt out of any marketing e-mails sent to you by these affiliates by contacting us using the information in Paragraph M with such a request or by waiting for an e-mail from the third party and unsubscribing at that time.

  8. Third-Party Resellers

    RKA may disclose your PII to any third-party resellers that may re-sell our Services to you. Since you were directed to our Website by these third parties, any information that you provided them is also subject to the third party's privacy policy.

  9. California Privacy Rights

    RKA is subject to California Civil Code § 1798.83 and, as such, must disclose to its California customers, upon request, the identity of any third parties to whom RKA has disclosed PII within the previous calendar year, along with the type of PII disclosed, for the third parties' direct marketing purposes.

    If you are a California resident and would like to make a request pursuant to California Civil Code § 1798.83, contact RKA in writing using the contact information listed in Paragraph M. Under California law, RKA is only required to respond to a customer request once during any calendar year.

H. How do you access and correct your information?

You may update and/or correct your information, including your PII, by logging into our Website and making the desired changes. As a Job Seeker, you may also delete your resume permanently from your account and our database. If a Job Seeker deletes their resume, however, the Job Seeker's resume may already be in the possession of employers who have previously downloaded it and the Job Seeker will not be able to delete the Employer's copy from our Website. In addition, if you have already applied for a position, the employers to which you have applied will still have access to your resume.

In addition, you may contact RKA (using the contact information listed in Paragraph M) to request modifications or updates to your PII. RKA shall require you to provide identification prior to RKA's making such changes. RKA reserves the right to refuse any requests that are overly repetitive or that require unreasonable time or effort on the part of our technical team. In addition, RKA reserves the right to refuse any request that undermines the privacy rights of others.

RKA has no control over copies of a Job Seeker's information that has already been downloaded by employers or that the Job Seeker has provided to third parties by clicking on links from our Website. If a Job Seeker wishes to correct this information with these employers or third parties, the Job Seeker must contact them directly.

I. How does RKA amend this Privacy Policy?

RKA may change this Privacy Policy at any time, without prior notice to you, by posting a new version on this page or on a successor page. The new version will become effective on the date it’s posted, which will be listed at the top of the page as the new Effective Date. You may access this Privacy Policy at any time by clicking on the "Privacy Policy" link on our Website’s home page. Your continued use of the Website is your acceptance of the new terms of the Privacy Policy.

If the RKA makes any modifications to this Privacy Policy that are materially less restrictive with regard to RKA's use or disclosure of your PII, RKA will notify you and ask for your permission before continuing use of your PII under these new terms.

J. What is RKA's online policy with regard to children?

RKA will not knowingly collect any information from children under the age of thirteen (13) as is consistent with the Children's Online Privacy Protection Act (COPPA). If, as a parent or guardian, you discover that your child under the age of thirteen (13) has supplied RKA with PII, you may contact RKA and we will remove your child's information from our database. Contact as us using this information provided in Paragraph M. In this communication with us, please provide the username and password used by your child to enter their PII onto our site.

K. What are RKA's Safe Harbor policies?

RKA is compliant with both the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework. These frameworks were set up by the U.S. Department of Commerce to regulate the collection, use, and retention of PII from European Union member countries and Switzerland. RKA adheres to these Safe Harbor principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. L. How can you opt out of automated communications from RKA?

You may receive e-mails, text messages, and pre-recorded phone messages from RKA regarding new service offerings, upcoming events, sales offers, and information specific to our Website. If you do not wish to receive these communications, you may opt out by following instructions that are included in these communications.
